By accessing or using the Nesion KV-Cache Eviction Engine, website, or services (collectively, the "Software"), you agree to be bound by these Terms of Service. If you do not agree to these terms, you may not use the Software.
Nesion is provided under two licensing models: the MIT License for non-commercial/single-GPU use, and a Commercial License for enterprise use. Your use of the Software is subject to the terms of the applicable license. Any breach of license terms automatically terminates your right to use the Software.
THE SOFTWARE IS PROVIDED "AS IS" AND "AS AVAILABLE", WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED.
Nesion Engineering and its contributors (the "Licensor") make no representations or warranties of any kind concerning the Software, including, without limitation, warranties of merchantability, fitness for a particular purpose, non-infringement, or the absence of latent or other defects, accuracy, or the presence or absence of errors, whether or not discoverable.
The Licensor does not warrant that the Software will meet your requirements or that the operation of the Software will be uninterrupted or error-free. The Software interacts with complex hardware and other software environments; the Licensor is not responsible for any hardware damage, data loss, or system instability resulting from the use of the Software.
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL THE LICENSOR BE LIABLE FOR ANY DAMAGES WHATSOEVER.
This includes, but is not limited to, direct, indirect, special, incidental, or consequential damages (including, but not limited to, procurement of substitute goods or services; loss of use, data, or profits; or business interruption) however caused and on any theory of liability, whether in contract, strict liability, or tort (including negligence or otherwise) arising in any way out of the use of this Software, even if advised of the possibility of such damage.
Specifically, the Licensor shall not be held liable for any financial losses or legal actions resulting from errors, inaccuracies, or hallucinations produced by Large Language Models (LLMs) when running Nesion, or for any unauthorized access to or alteration of your data.
You agree to indemnify, defend, and hold harmless Nesion Engineering and Carlos Costa Garcia from and against any and all claims, liabilities, damages, losses, or expenses, including reasonable attorneys' fees and costs, arising out of or in any way connected with your access to or use of the Software.
These terms shall be governed by and construed in accordance with the laws of Spain, without regard to its conflict of law provisions. You agree to submit to the personal and exclusive jurisdiction of the courts located in Madrid, Spain.
